First off I want the make people aware that we have many of the most important conversations with Ocwen recorded so there is no we say/they say.

We were offered and agreed to a loan modification from Ocwen signed and dated in June 29, 2010. We sent in the down payment/first payment at the end of June per our modification agreement.

On july 16 we received a letter from a local attorney stating that Ocwen had referred our home loan to them for foreclosure for a default on the loan. My Husband called Ocwen and asked them why they started foreclosure and they said that the modification would be entered into their system and the correct information would reflect in our account soon.

We replied to Ocwen's attorneys office and sent them all the information needed to dispute this error made by Ocwen. We them called the attorneys office to see if they had received all the information and they had. The attorney's office told us that they could not reach Ocwen and asked us to try to have Ocwen contact them. My husband even made a conference call between Ocwen and their attorney's office and was told by Ocwen that they could see that a mistake was made and they would get it resolved.

We have a screen shot of our account online taken on July, 19, 2010 showing a message that our modification and payment had been received. The screen shot shows the information about our loan before the modification but shows the next payment due according to our modification.

We made our Aug. mortgage payment over the phone in Aug. 2010 and it was accepted. We made our payment in the form of a personal check for the amount due according to the modification in September. They sent the check back claiming it wasn't enough to satisfy the default.

We called Ocwen and the claimed that we did not have a loan modification with them. My husband again told them that we have in our possession a loan modification agreement with them. They conveniently found our modification agreement in a matter of seconds after we gave them that information. The home retention specialist told us to wait a few days before sending the September payment back so that the same thing wouldn't happen. He called my husband back like he said he would in a couple of days and said that everything had been straightened out.

About two weeks later, my husband received a call from their collections department stating that they were trying to collect a debt and that the September payment had been rejected again. It was the collections department again having no knowledge of the modification. He asked to be transferred to the home retention specialist.

The specialist then said he didn't know why the payment was rejected again and that he would again call back after he had figured out why this was still happening. Again, he called my husband back a day or so later and said that he could then send in the payment again, but that it needed to be certified funds. He also advised that my husband wait a week or two before sending in the October payment so that it wouldn't be confused with the September one.

On November 1, 2010 I found a Notice of Trustee's Sales set for December 1, 2010 taped to my front door.

Since, we haven't received any payments back, as of today, November 2, the September (certified funds) payment has still not been accepted/cashed nor has October's payment. Our Home Retention Consultant will not return our phone calls

Ocwen has left us no choice but to get an attorney and fight them.

We also did a modification with them. Got it approved, and they sent a notice that they had stopped the sale of our house.

Then we went to make the first modification payment and they said they had sold the house to a different department because our April 1st payment was due in March?? Nothing on our modification papers say that. And then they never sent us any information at all about the sale. Turns out that they never stopped the sale and we are close to eviction and STILL have not heard from them.

We got through to someone who said that the agreement does NOT say we need to pay in March and there is no reason whatsoever in their own paperwork about WHY they refused our payment in April.

Not sure what we can even do about it.

We have almost exactly the same problem except our modification loan never was signed by them and returned to us, and they never told us that they accepted it.We got two statements saying two different things and neither had the right balance agreed upon. So I said after the first two payments if they are not going to respond after two submittals of the Mod Papers - I'm not paying any more money; so from April until now we have made no papyments and in Dec we started hearing from them again.

This company is such a joke.

We are now talking with a paticular rep and they are offering their new program where they get a percentage of your home value at sell but we get a 2.33% rate for 5 years and 4.5% after that. So we may take it, I'm still thinking this through and want to see the total agreement.

The sad thing is, even though they have acknowledge that this mess is all their fault, they do not care about their reputation at all. We can sue all we want, and they'll just file for bankruptcy.

So we are told to take any offer they give us. It makes me so mad. we lost over $20,000 worth of income because of this company, and all they have offered is to cover our lawyer fees up to $1500.

Unfortunaly in Utah I guess the judges side with the banks/Loan servicing companies almost eve time, even if it is the banks/servicing companies fault.

Ocwen has admitted that they messed up. We are still in the middle of the lawsuit and have not come to an agreement.

We still have our home and Ocwen has canceled the foreclosure. Only because they legally had to.

That's all I have for now. I will update when we have this messed resolved.

What ever happened? Did you lose your home? Did they honor the modification contract?

Ocwen has postponed the sale of our home to Jan. 12 because we hired a lawyer.

Had we not our home would be gone. We have filed a lawsuit against Ocwen and their trustee which is the law firm representing Ocwen.

I will keep updating this post with as much info. as my lawyer allows me too as well as the outcome.

It's Dec. 15 now, please advise of sales status!!!

I'm concerned for all of us, especially the people with kids and the person with 4 dogs. Did they sell your house at auction? Are we all doing lawsuit?

I'm in the foreclosure/modification process at the moment myself. I, however, was one of the VERY lucky few who got a modification 14 months ago.

All they did was remove my home from sale and added all kinds of late fees and additional fees every month to make my original $2,600.00 payment go up to $4,100.00. How the heck do they think they helped me out??

Where the heck are Obama's people on this? I know they have to read some of our emails.

I have been researching other lawsuits against Ocwen and I have found in every case that Ocwen claims in there defense that they ARE NOT a debt collector... Yet when you call they say that they are...

OWCEN is a debt collector therefore:

they took over our loan at the beginning of the year, and Ocwen refuses to honor our loan remodification done in 8/09. They have raised our interest rate by 3%.

I cannot make those huge payments, which is the whole reason we did the loan remodification, which is supposed to be fixed interest until 2013. They have been totally unresponsive to letters, including copies of our loan remodification, Calling is useless. What to do?

If i didn't have 4 dogs, i would tell them to take the house, but who is going to rent to us? I guess the next step is a lawyer

Im in the same situation. I have bn given 4 different amounts to sastify our mortgage.

Now their attorney want 2000.00 more than the reinstatement amount...

I am filing a federal lawsuit to take down these monsters and i have an interview on my local tv station next week. Contact me on Dec 4th or 5th at724-557-**** you want to join in...I wont let them take my home!!!!

Update... So Ocwen LLC is now claiming that they have not entered our Loan Modification into there systems yet.

Are you kidding me!!! It's been over 4 months. OCWEN offered US the modification which WE signed, dated, had notarized and sent in our payments. To which they accepted and makes it a legal binding contract, yet they are still going forward with the auction of our house Dec. 1, 2010 because OCWEN has not entered it in their systems. They even ADMIT on record that it is their mistake.

Oh Ocwen... What are you doing???

OMG!!!!

This company JUST took over my loan Sept 1st and I have received TWO packets about "Alternatives TO Foreclosure" and now they will send me Modifications paperwork.....all I read online is NOT good about this "servicer"!!!!!

AND they cant even tell u WHO ur morgage is with now....ahhh hello ur JUST the servicer so WHO are you servicing FOR????? Can't answer that....hmmmmm TIME to get lawyer!
